The Variable Is Not Geography
Section 1308 applies to vacant and abandoned one to four family residential property throughout New York, and its duties attach only to the first lien mortgage holder. Nothing about Cheektowaga, Tonawanda, Amherst, West Seneca, Lackawanna or Kenmore changes that.
What does change is who your loan sits with. Large national servicers, regional banks and credit unions run these obligations differently, and the difference in how a file is handled is far larger than any difference between these towns. Why the Difference Shows Up After a Fire
A servicer with a well-run process notices a fire, notes the reason for delinquency, and handles the file as what it is. One without notices only a missed payment and a property that looks empty from the pavement.
Both are following the same statute. The first produces a conversation and the second produces a notice on your door.
Can I Influence Which One I Get?
We publish no loan positions, servicer assessments or values for individual first ring properties. Your mortgage statement, the county clerk's records and a New York lawyer answer those.
Higher Values Change the Arithmetic
Across much of Amherst, Kenmore and parts of Tonawanda finished values carry the cost of repair comfortably, which makes repairing better than selling on sound stock and makes catching up a delinquent loan more clearly worth doing.
Where values are more modest, the calculation of whether to repair, catch up or sell is genuinely closer, and it is worth doing with real numbers rather than under pressure.
Later Construction Decides the Repair
Much of the post-war suburban stock uses engineered roof trusses and floor systems, which come out whole once heat has compromised the connections, where the older housing closer in uses dimensional framing that chars and can frequently be retained.
An engineer settles which you have, and it decides whether the property is in the repair market or the rebuild market.
Winter Applies Out Here Too
Water entering a fire-damaged structure freezes, expands and thaws repeatedly through a Buffalo winter, and charred timber that could have been assessed and retained in autumn frequently cannot be by spring. Securing the building is the cheapest work available and the only item that gets more expensive with delay.

The Statute Behind Every Town in the Ring
Sections 1308, 1309 and 1310 of the RPAPL, effective 20 December 2016, apply identically across the state. Inspection follows within 90 days of delinquency, repeating every 25 to 35 days at varying times.
A notice goes up within 7 business days of a determination, section 1310 reporting begins at 90 or more days delinquent, and penalties reach $500 per day per property under section 1308(8).
