Why the Temptation Is Strongest Here
Where a repaired house would be worth little more than the cost of repairing it, and a loan is behind, and a notice has appeared on the door, the rational-looking move is to stop.
That reasoning is understandable and it is usually wrong, because stopping does not end the relationship. A foreclosure runs, and section 1309's expedited route exists precisely to make it run faster on properties nobody is dealing with. The framework is on our page covering the inspection and the registry.
What Actually Happens If I Walk Away?
A Low Sale Is Still an Exit
On weak values a cash figure can look insulting. Compare it against the alternative rather than against what the house once seemed worth: continuing carrying costs, a deteriorating building, and a process running on somebody else's timetable.
Where there is any equity at all, getting to it before the process does is the difference between keeping something and keeping nothing.
What If There Is No Equity?
We publish no loan positions, deficiency assessments or values for individual Western New York properties. A New York lawyer, your servicer and local sale evidence answer those.
Distance Widens the Offers
Away from Buffalo, contractors price travel and buyers price uncertainty about access and services. That spreads the offers on the same property considerably, because those who have visited price accurately and those who have not guess.
Getting somebody to the property matters more here than in the city, where a buyer can form a reasonable view from the street.
Older Stock, Harder Winters
Housing across these counties is largely older, with dimensional framing that chars on the surface and can frequently be retained where it has been kept dry. The qualification matters: winters out here are at least as hard as Buffalo's and frequently harder.
Securing a building before the first freeze is the cheapest and most consequential work available, and on weak values it can be the difference between a repairable house and a lot.

The Sections That Do Not Change By County
Sections 1308, 1309 and 1310 of the RPAPL took effect on 20 December 2016 and apply throughout New York, covering 1 to 4 family residential property.
The timetable is the same everywhere: inspection within 90 days of delinquency, repeats every 25 to 35 days, notice within 7 business days, non-response measured over 7 consecutive days, and registry reporting from 90 days delinquent.
Regional Questions
Is It Worth Selling at These Numbers?
Compare it to what happens if you do nothing rather than to what the house once seemed worth. That is usually the honest comparison.
Can I Just Hand Back the Keys?
Whether anything like that is available depends on your loan and your circumstances, and it is a question for a New York lawyer rather than for a buyer.
Will You Buy in Niagara Falls or Jamestown?
Yes, across Western New York, and we will come and look rather than pricing from a map.
